At Howard L. Lotven, A Professional Corporation, we act as a buffer between our clients and the system. We protect our clients from overcharges and negotiate for the option of probation instead of a jail sentence. Within family law, we work hard to win custody for our clients and determine a living situation that will be in the best interest of the child.
Legal Fields and Experience:
Presently, I primarily represent clients in Criminal/Municipal Courts and Traffic Courts. I have been either a prosecutor or defense attorney in over 10,000 cases. I also represent clients in Family Law matters including divorce, paternity, modification of child support, custody and visitation. In the past and currently a portion of my practice is in personal injury cases/auto accidents.
I have also argued six cases in front of the Missouri Court of Appeals - Western District:
1. Lane v. Amsted Industries, Inc. - Product Liability Claim - Appeal regarding the appropriateness of jury's consideration of a Plaintiff's worker's compensation claim in a suit for product liability.
2. Eimer v. Board of Police Commissioner of Kansas City, Mo - Worker's Compensation Claim - Appeal regarding the appropriateness of an employee's employment history being entered into evidence in a worker's compensation claim.
3. Todd v. Lohman - Driver's License Suspension - Appeal regarding the procedures under the Missouri Department Of Health Code Of Regulations that a lab technician must follow to have a valid test for blood alcohol content.
4. Peterson v. Summit Fitness, Inc. - Personal Injury - Appeal regarding the standard for Aopen and obvious danger@ defense as it relates to children.
5. In Interest of R.C. - Termination Of Parental Rights - Appeal regarding whether evidence regarding the child's statements made to other children is admissible and whether sufficient evidence of abuse was presented to terminate parental rights.
6. Baldridge v. Director of Revenue - Driver's License Suspension - Appeal regarding reinstatement of Petitioner's driver's license when Circuit Court Judge found the police officer's testimony not credible.
7. Brown v. Brown - Successfully argued a change in the law (ie: right to receive a credit) where the parent paying child did not receive from parent receiving child support proof that the child was in college under Missouri law.
