Conditional Permanent Residence
Conditional Green Cards are temporary resident permits granted to spouses of U.S. citizens and entrepreneurs who meet specific criteria. They are issued for two years and have certain conditions that must be met for the cardholder to maintain their legal status in the United States.
For spouses, conditional permanent residence is typically obtained through marriage to a U.S. citizen. They must jointly file Form I-751, Petition to Remove Conditions on Residence, to remove the conditions within the 90-day window before its expiration.
Entrepreneurs can also obtain conditional Green Cards through investment in a qualifying U.S. business. Like spouses, the timeframe to lift the restrictions is typically within the 90-day window before the card’s expiry date. However, they need to use Form I-829, Petition by Entrepreneur to Remove Conditions, for their application.
These petition programs allow individuals to live and work permanently in the United States. They can even lead to citizenship through naturalization if other requirements are met.
